Use of the App

MindFlips is a flashcard learning application that allows users to create, organize, and study flashcards. The App may offer both free and premium features.

You may use the App for personal, non-commercial purposes only. You must not:

• Use the App in any way that causes, or may cause, damage to the App or impairment of its availability or accessibility
• Use the App in any way that is unlawful, illegal, fraudulent, or harmful
• Use the App for any purpose related to marketing without our explicit consent
• Export or distribute any part of the App in violation of applicable export laws and regulations

Purchases and Subscriptions

MindFlips is free to download and use with limited features. To unlock all premium features, you must purchase a subscription. There is no free trial period. All purchases are processed through the Apple App Store and are subject to their terms and conditions. Prices for subscriptions are subject to change upon 30 days' notice from us. Such notice may be sent to you via email or published on the App.

You acknowledge that:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your account settings on the App Store

User Content

Our App allows you to create and store content such as flashcards and deck information ("User Content"). You retain all rights to your User Content, and you are responsible for it, including its legality, reliability, and appropriateness.

By creating User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, publicly perform, publicly display, reproduce, and distribute your User Content in connection with providing the App services to you.

Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of MindFlips and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including, without limitation, if you breach the Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App or delete it from your devices.

Limitation of Liability

In no event shall MindFlips, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

Disclaimer

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on the App. You are advised to review these Terms periodically for any changes.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
